Terms of Use

The Services provide information and tools for bunker procurement and related analytics. They are not a substitute for professional judgment, contractual due diligence, official publications, or onboard systems. Always verify outputs, prices, availability, voyage inputs, consumption, emissions, ETS estimates, and operational decisions using your company’s ERP, onboard reporting, and navigation / voyage planning systems (including ECDIS where applicable), and with suppliers / port agents.

1) Acceptance of these Terms

These Terms of Use (“Terms”) govern your access to and use of the website, platform, applications, APIs, content, and related services operated by bukering.ai (“we”, “us”, “our”, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2) Eligibility and authority

The Services are intended for business use. You represent that you are legally capable of entering into these Terms and (if you use the Services on behalf of a company) you have authority to bind that entity.

3) Accounts and security

  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • You must provide accurate, current information and keep it updated.
  • Notify us immediately of any unauthorized use or suspected security incident.

4) Services and outputs

The Services may include (without limitation) bunker price indications, market intelligence, RFQ and negotiation workflows, voyage/cost scenario tools, emissions and ETS-related estimates, alerts, dashboards, and reports.

  • Informational only: Outputs are provided for convenience and planning purposes only.
  • Verification required: You must independently verify all outputs (including prices, quantities, specifications, availability, taxes/fees, delivery conditions, routes, distances, consumption, emissions and ETS estimates) using your ERP, contracts, supplier confirmations, and navigation/voyage planning systems.
  • No operational control: The Services do not control vessel operations, navigation, safety, procurement decisions, or supplier performance.

5) AI / automated features

Some features may use automated or AI-generated outputs. Such outputs may be incomplete, inaccurate, or outdated, and may not reflect real-world constraints (e.g., weather, port restrictions, safety, contractual terms). You remain solely responsible for decisions made based on outputs.

6) User content

You may submit content such as RFQs, messages, attachments, vessel/route inputs, and other data (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display User Content solely to provide and improve the Services and to comply with law.

You represent you have all rights necessary to submit User Content and that it does not violate law or third-party rights.

7) Acceptable use

You agree not to:

  • Use the Services for unlawful activities, fraud, or deceptive practices.
  • Interfere with or disrupt the Services, or attempt to bypass security or access controls.
  • Reverse engineer, scrape (except as explicitly permitted), or extract data at scale without our written permission.
  • Upload malware, or content that is infringing, confidential (without authority), or otherwise harmful.
  • Misrepresent identity, affiliation, vessel ownership/management, or authority in RFQs or negotiations.

8) Third‑party services and data

The Services may include third-party links, integrations, or data feeds. We do not control third parties and are not responsible for their availability, accuracy, pricing, performance, or terms. Your use of third-party services is at your own risk.

9) Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE”.
To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.
  • No guarantee of accuracy: Prices, availability, port details, routes, distances, emissions, ETS estimates, and analytics may be delayed, incomplete, or incorrect.
  • No professional advice: Nothing in the Services constitutes legal, tax, compliance, safety, or navigation advice.
  • No guarantee of savings or performance: We do not guarantee cost savings, outcomes, or supplier performance.
  • Operational decision disclaimer: You must not rely solely on the Services for navigation, safety, compliance, or operational decisions. Always cross-check against ERP, onboard systems, official notices, and professional judgment.

10) Limitation of liability

To the maximum extent permitted by law, in no event will bukering.ai, its directors, employees, contractors, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, business, contracts, goodwill, data, or vessel downtime, even if advised of the possibility of such damages.

Cap on liability: To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services will not exceed the amounts paid by you to us for the Services in the 3 months preceding the event giving rise to the claim, or EUR 100 if you have not paid any fees.

Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, certain liabilities for fraud or willful misconduct where prohibited).

11) Indemnity

You agree to defend, indemnify, and hold harmless bukering.ai and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Services, (b) your User Content, (c) your violation of these Terms or law, or (d) your dealings with third parties (including suppliers/brokers).

12) Intellectual property

The Services, including software, text, graphics, UI, trademarks, and compiled content, are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes, subject to these Terms.

13) Suspension and termination

We may suspend or terminate access to the Services at any time (with or without notice) if we believe you have violated these Terms, pose a security risk, or if required by law. You may stop using the Services at any time. Sections that by their nature should survive will survive termination (including disclaimers, limitation of liability, and indemnity).

14) Governing law and venue

Unless otherwise required by mandatory law, these Terms are governed by the laws of Cyprus, and the courts of Cyprus will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

15) Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date. Continued use of the Services after changes become effective means you accept the updated Terms.
